Terms and Conditions

These Terms and Conditions ("Terms") govern your use of services provided by Polar Breeze LLC ("Polar Breeze," "we," "us," or "our") and our website at polarbreezeut.com. By booking service, paying an invoice, or using our website, you agree to these Terms.
1. Services and Service Area
Polar Breeze provides residential and commercial HVAC service, installation, system design, performance audits, remediation, maintenance, consulting and second opinions, and The Yogi Lab paid phone consultation service. On audits and second opinions, findings are independent: measurement drives the diagnosis, never the sale.
- On-site HVAC service: available within a 100-mile radius of our Orem, Utah location.
- The Yogi Lab phone consultation: available statewide in Utah.
- HVAC design work: available statewide in Utah.
We reserve the right to decline service in areas, properties, or situations that fall outside our scope, expertise, or safety standards.
2. Booking and Appointments
Appointments can be booked through our website, by phone, or by text. We make reasonable efforts to arrive within the scheduled time window. If we will be late or need to reschedule, we will notify you as soon as possible. You may reschedule or cancel an appointment by replying to your confirmation message or calling us. We appreciate at least 24 hours of notice for cancellations.
3. Pricing and Payment
Pricing for our services is established and disclosed in writing before work begins, except in emergency or after-hours situations where a verbal estimate may be provided initially and confirmed in writing afterward.
Standard pricing for our consultation services:
- The Yogi Lab phone consultation: $34.95 (launch promotional rate) or $49.99 (standard).
On-site service work is quoted per job based on the scope of work and the diagnosis. Payment is processed via QuickBooks Payments. We accept check, ACH transfer, credit and debit cards (a 3% processing fee applies to card payments), Venmo, and Zelle. Payment is due upon receipt of invoice unless otherwise agreed in writing.
4. Audit-to-Design Credit
Customers who pay for a Polar Breeze audit are typically eligible for a credit equal to the audit fee, applicable toward a subsequent design engagement under the Comprehensive Service Agreement (excluding add-ons and rush charges). Audit credits expire 90 days from the date of audit. Credits are non-transferable and have no cash value. The signed Audit Services Agreement governs the credit's terms.
5. Yogi Lab Credit
Each paid Yogi Lab consultation earns a $15 Polar Breeze credit good toward any Polar Breeze service. Credits are valid for one year from issuance and stack up to a maximum of $75. Credits are applied to your invoice and may not exceed the value of the service being paid for; they carry no cash value, and no change or refund is given for unused credit. (Example: on a $34.95 Yogi Lab call, two stacked credits — $30 — leave a $4.95 balance.)
6. SMS Messaging
By providing your phone number to Polar Breeze, you consent to receive transactional and customer-service text messages from us, including: appointment confirmations, on-the-way notifications, post-service summaries, payment receipt links, scheduling reminders, and conversational responses to your inquiries. Message frequency varies based on your service activity. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help.
SMS Consent and Mobile Information Sharing. The mobile information collected through SMS opt-in (your phone number and your SMS consent) will NOT be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data is excluded from any other categories of data sharing described in our Privacy Policy. 7. Warranties
- Workmanship warranty: We warrant our repair labor for one (1) year from the date of completion, unless a longer period is stated in writing for a specific job. (Remediation engagements carry their own 24-month written guarantee under the signed Remediation Services Agreement.)
- Equipment warranties: Equipment coverage comes from the original manufacturer, typically one (1) to ten (10) years depending on brand, component, and registration. Polar Breeze provides service, installation, design, consulting, and second opinions. On audits and second opinions, findings are independent: measurement drives the diagnosis, never the sale. We assist customers with manufacturer warranty claims on equipment we service.
- Exclusions: Equipment itself is not covered by our workmanship warranty, except where we are explicitly contracted to service it under a separate written agreement.
Design, audit, and remediation engagements carry their own written warranty and guarantee terms (including the 24-month design warranty) under the signed agreements, which govern over this section for those services. (Performance Guarantees apply to Premium and Elite design tiers only; the Standard tier carries a limited warranty and design-error remedy cap, not a Performance Guarantee.) Warranty claims must be reported promptly. Failure to report a warrantable issue within a reasonable time may void the warranty for that issue.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Polar Breeze is not responsible for any indirect, incidental, special, consequential, or punitive damages arising from our services or website. Our total cumulative liability for any claim related to a specific service shall not exceed the amount you paid Polar Breeze for that specific service. Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
9. Intellectual Property
The Polar Breeze name, logo, website content, photographs, and the "We test. They guess." tagline are the property of Polar Breeze LLC. You may not reproduce, redistribute, republish, or use these for commercial purposes without our prior written permission.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any dispute arising out of these Terms or our services shall be resolved in the courts of competent jurisdiction located in Utah County, Utah.
11. Changes to These Terms
We may update these Terms as our business or applicable laws change. The "Last Updated" date at the top reflects the most recent change. Your continued use of our services or website after a change constitutes acceptance of the revised Terms.
